Shopify店鋪侵權如何投訴和處理？獨立站不是法外之地

先明確的說，無論是 Shopify，PayPal，還是 Stripe 或者 2Checkout，對侵權行爲都是有權做出暫停服務，甚至直接封號處理的。如果我們違反了他們的服務條款，他們就有權拒絕爲我們提供服務，沒毛病。話說的很明白了，至於是“富貴險中求”，還是“君子愛財取之有道”，每個人有自己的想法和價值觀，就不做評論了。

最近 Shopify 在國內不太穩定，如果打不開 Shopify 官網, 或者打開速度很慢，無法註冊或者登錄 Shopify 賬戶，請使用“魔法”重試，你懂的。

其實不僅僅國內網友經常會提問能不能用 Shopify 獨立站賣仿品，或者侵權周邊產品，國外網友看到其他賣家銷售侵權產品也會有這樣的疑問：(www.reddit.com)

帖子中的鏈接已經無法打開了，不過，點擊 Annual Revenue 鏈接地址之後跳轉到的是 Shopify 網站交易平臺，說明當時該網站在做到年銷售額近100萬美金的時候，想要賣出去了。至於是不是因爲侵權問題想要出售已經沒有辦法證實，不過評論裏面有句話說的很真實“Right now we are not spending money on ads due to our marketing operations halted.”

用時光機Archive看了下這個網站，算是一個爆款產品垂直站，當時這個音樂盒應該有相當多的人賣過吧？沒賣過應該至少見過這個產品吧？當時這款音樂盒賣爆的時候，我也有測試過這類相關的產品。當時就比較好奇，因爲擔心涉及到侵權問題導致收款賬號出問題，沒有跟賣。

這個網站存在也就一年左右的時間，Whois History 顯示域名是在2017年9月13日註冊的，時光機顯示2018年8月的時候已經打不開了，江湖上只留下了這個網站的傳說。

我自己也經歷過幾次因爲侵權收到的警告，印象深刻的有3次，都發生在同一個銷售寵物用品的網站上。這些不算是什麼光榮的事情，拿出來分享作爲警示。

Shopify 域名侵權

網站當時起名字註冊域名，用的就是把競爭對手們的網站域名收集起來然後重組。直接在Google裏面搜索Niche裏面的主要關鍵詞，然後將搜索結果裏面的根域名，尤其是那種兩個單詞或者三個單詞組成的域名一一錄入到Excel表格裏面，至少50個域名吧，然後把這些域名拆解重組。再把那些重組好的看着有意義的域名全部扔到Namesilo或者阿里雲裏面看看哪些域名是可以註冊的，可以註冊的域名裏面，再進一步篩選，並最終確定出來我想要的域名。

舉個例子：比方說搜索某個Niche主要關鍵詞之後，出現了以下幾個根域名

• PayPal.com – 拆解 Pay / Pal
• FashionNova.com – 拆解 Fashion / Nova
• Colourpop.com – 拆解 Colour / Pop
• Barkbox.com – 拆解 Bark / Box

然後再對這些拆解出來的單詞重新組合成類似 Barkpal，ColourNova，FashionPop等等域名，這類域名或者品牌名稱通常看起來還是“逼格滿滿的”。再把它們扔到 Namesilo 或者阿里雲裏面看看哪些域名可以註冊。再進一步篩選即可。

然後，就拼出來一個 247PetDepot.com 這個域名，綁定到了 Shopify 網站來銷售寵物用品，沒想到後來廣告上了沒今天就收到了Shopify 官方的郵件，說域名侵權了，要麼提供相關的授權，要麼更換域名。原來是 PetDepot.com 告了我這個小破站。郵件原文如下：

Hello there,

Sacha with Shopify here,

Unfortunately, we received the attached Notice of Trademark Infringement. Shopify supports the protection of all intellectual property and asks Shopify merchants to do the same. It is our policy to respond to all notices of alleged trademark infringement.

Consistent with our procedures relating to assertions of intellectual property Infringement, we may proceed with taking the content listed as infringing offline in approximately 72 hours.

We value you as a customer and would like to give you a fair opportunity to respond to the Notice, by providing you with 5 business days to respond via the attached form titled (Response to Notice of Trademark Infringement). Please note that if you materially misrepresent that a product or activity is not infringing upon the trademark rights of a third party, whether in a response or otherwise, you may be liable for damages (including costs and attorney’s’ fees). If you are unsure whether the material infringes on third party intellectual property rights, please contact an attorney before contacting Shopify with your Response.

Upon receipt of your timely response, Shopify will provide the original complainant with your Response. Shopify may also cease disabling/reinstate the content within ten (10) business days at Shopify’s discretion. The original complainant will then have ten (10) business days after it receives a Response to seek a court order restraining you, the merchant, from engaging in the infringing activity.

Please know that although your business is important to us, the intellectual property rights of others are also important to us.

做了錯事改正就好，按照要求修改了網站的域名。

這裏還要多說一點的是，如果我們的域名用了很長時間了，做了很多廣告和外鏈，但因爲侵權不得不更換域名，在將新購買的域名添加到Shopify後臺之後，記得務必將原來侵權的域名保留在 Shopify 後臺，這樣，Shopify 才能自動添加301重定向，原來的廣告鏈接，以及外鏈鏈接才能正常的通過新綁定的域名打開我們網站原來域名對應的頁面。

Shopify 獨立站產品圖片侵權

還是這個寵物用品網站，當時網站上的產品圖片都是從供應商 1688 的網站上扒的，沒想到供應商的圖片是從亞馬遜上扒的，就是下面這張圖片，這次倒不是 Shopify 官方給我發的郵件通知，而是這個賣家 4Knines 直接給我發的郵件，說我網站盜用他們的圖片，要求立即下架。

當然，這個是事實，沒有什麼好說的，直接下架圖片，並誠摯道歉了事。

Shopify 產品描述侵權

英語水平有限，當時做一件代發 Dropshipping，Shopify 店鋪裏面大部分的產品的描述要麼是照搬亞馬遜的，要麼是 etsy，競爭對手獨立站，沃爾瑪的產品描述複製過來拼湊到一塊兒的，然後當時 Facebook 廣告效果剛剛起來的一款貓毛刷產品就因爲產品文案侵權被投訴了。如下圖這款產品：

當時看到有別人在跑相關的產品，我就跟進了下，廣告效果不錯，出了不少單。當時的產品描述是從某個網站直接抄過來的，圖片也用了幾張，估計是那個網站看到了我的廣告吧，然後就投訴到 Shopify 了，於是就有了下面的郵件。這個確實是抄的，沒得狡辯，老實承認，然後修改掉就好了。

通常，如果我們的 Shopify 獨立站上有相關內容侵權了，Shopify會發郵件通知我們，要求我們在規定的時間裏面做出相應的處理，算是給我們一個機會解釋。如果我們在規定的時間裏面沒有做出任何迴應，那麼 Shopify 就有可能會依據服務條款直接採取類似下架產品，刪除相關內容，暫停賬號，甚至是直接封號的處理。因此，日常查看 Shopify 發送的郵件，並及時做出處理是非常非常重要的一件事情。

因爲侵權產品導致 2Checkout 賬戶申請不下來

另外，在之前我申請 2Checkout 賬戶用於信用卡收款的時候，也遇到了因爲網站產品侵權而導致賬號申請不通過的情況發生的。那個是定製T恤的網站，某個產品圖片上有迪士尼的卡通形象，在提交 2Checkout 賬戶申請的請求之後，2checkout 回覆說網站上有侵權產品，但是沒有明確說是哪個產品，在我自己檢查網站內容的時候懷疑是迪士尼圖片侵權，下架產品重新提交申請之後 2Checkout 收款賬戶順利申請下來。

再後來，只要自己擔心有侵權問題的產品，就儘可能不碰了。PayPal 和 Stripe 到目前還沒有收到任何侵權投訴。

所以，獨立站不是“法外之地”，獨立站侵權同樣會收到警告甚至懲罰。

獨立站侵權如何投訴

那如果我們的Shopify獨立站商標或者內容被侵權了怎麼辦？如果侵權方使用的是 Shopify 搭建的獨立站，那麼你可以直接將相關侵權信息提交給 Shopify，他們會幫你解決問題的；如果對方使用的是其他建站程序如BigCommerce，同樣也會收到 BigCommerce 的管制；

Shopify 侵權投訴：

• www.shopify.com/legal/dmca

如果對方使用的是開源程序如 WordPress 或者 WooCommerce，則可以查詢該網站所使用的主機服務商，並將投訴申請提交到主機服務商那邊，主機服務商會採取相應的措施。如下圖就是主機服務商 Siteground 對網站侵權內容的處理辦法，以及對侵權行爲的投訴郵箱地址：

不過最有效率的解決辦法還是直接發郵件或者打電話聯繫到侵權的網站，警告他在規定時間內下架相關的內容。通常會很快的解決問題，如果不行的話，再直接聯繫 Shopify 客服，或者通過上面提供的鏈接地址投訴到相應的部門，由Shopify或者其他網站服務提供商代爲處理侵權問題。
